Die Bundesregierung hat einen Gesetzentwurf zur Cannabisreform beschlossen. Dieser wird nach der Sommerpause im Bundestag beraten.

Der Entwurf sieht vor, dass erwachsene Menschen straffrei bis zu 25 Gramm Cannabis besitzen dürfen. Auch die kontrollierte Abgabe von Cannabis wird legalisiert.

Damit gehen wir einen Schritt hin zu einer fortschrittlichen und gesundheitsorientierten Drogenpolitik, die eine Balance zwischen individueller Freiheit und Jugend- und Gesundheitsschutz schafft.

Der Konsum von Cannabis ist seit Jahrzehnten eine gesellschaftliche Realität. Das Ziel, Menschen von einem Konsum von Cannabis abzubringen, wurde zu keinem Zeitpunkt erreicht. Eine ideologisch motivierte Verbotspolitik hat dies ignoriert und vor allem große gesundheitliche und gesellschaftliche Probleme verursacht. Es ist ein Schwarzmarkt entstanden, auf dem weder Jugend-, noch Gesundheits- oder Verbraucherschutz gelten.
Vor diesem Hintergrund ist der nun vorliegende Gesetzentwurf für eine Reform der Cannabispolitik, der auf eine Vereinbarung im Koalitionsvertrag zurückgeht, ein wichtiger Meilenstein hin zu einer fortschrittlichen und gesundheitsorientierten Drogenpolitik. Dieser Gesetzentwurf stellt die erste Säule der in der Bundesregierung vereinbarten Reform dar. Zu einem späteren Zeitpunkt soll ein Gesetz als zweite Säule der Reform regionale wissenschaftliche Modellprojekte zur kommerziellen Abgabe von Cannabis ermöglichen.
Das Bundeskabinett hat einen Gesetzentwurf zur Cannabisreform beschlossen. Dieser sieht eine kontrollierte Abgabe an Erwachsene vor. Damit gehen wir einen Schritt hin zu einer fortschrittlichen und gesundheitsorientierten Drogenpolitik.
Diese Regelungen müssen nach Ansicht der Bundesregierung nicht der EU-Kommission oder anderen Mitgliedsstaaten vor Verabschiedung zur Prüfung der Vereinbarkeit mit EU-Regelungen zum Binnenmarkt vorgelegt beziehungsweise angezeigt werden (Notifizierung), da kein kommerzieller Markt für Cannabis geschaffen wird. Eine Notifizierung durch die EU-Kommission beziehungsweise andere Mitgliedsstaaten hätte das Reformprojekt erheblich verzögert oder ganz zum Scheitern gebracht.
Weitere Verbesserungen im Gesetzgebungsverfahren
Der nun im Bundeskabinett beschlossene Gesetzentwurf wird nach der Sommerpause im Bundestag beraten. Wir werden in den Verhandlungen mit SPD und FDP insbesondere darauf achten, dass unsinnige Bürokratie abgebaut wird und keine unnötigen Hürden für Cannabisclubs errichtet werden. Das betrifft beispielsweise Abstandsregelungen, Konsumverbote in der Öffentlichkeit und das Verbot, in den Cannabisclubs auch zu konsumieren. Die Regelungen müssen insgesamt so ausgestaltet sein, dass der Schwarzmarkt ausgetrocknet werden kann. Auf diese Weise werden im Übrigen auch die Strafverfolgungsbehörden wirksam entlastet. Außerdem sind Verbesserungen etwa im Bereich des Straßenverkehrsrechts notwendig. Niemand darf unter Wirkung von Cannabis ein Fahrzeug führen, aber die aktuelle Kriminalisierung mündiger Erwachsener durch die Hintertür, etwa weil Erwachsene irgendwann und gar nicht im zeitlichen Zusammenhang mit der Autofahrt Cannabis konsumiert haben, muss beendet werden.
Regionale Modellprojekte
Die Bundesregierung muss nun verabredungsgemäß zügig einen weiteren Gesetzentwurf vorlegen, der auf fünf Jahre befristete, wissenschaftlich begleitete Modellprojekte ermöglicht. In diesen Modellprojekten soll die Wirkung einer kommerziellen Abgabe von Cannabis überprüft werden. Unternehmen wird in diesen regional begrenzten Modellprojekten erlaubt, Genusscannabis unter staatlich kontrollierten Bedingungen zu produzieren, zu vertreiben und an Erwachsene abzugeben.
